Adult Destitute Child


If the court finds that the child is an adult destitute child, support can continue past age 18 for as long as the child remains an adult destitute child. The Maryland child support guidelines apply to support for adult disabled children, and the guidelines represent the starting point for determining that support.


Md. Code § 13-101 defines a destitute adult child as a person who 


(1) has no means of subsistence; and  

(2) cannot be self-supporting, due to mental or physical infirmity. 


The individual shall pay the support until the destitute parent or destitute adult child has other means of adequate support or dies.
